Legality of Adultery in the US.

Adultery shouldn’t be a crime because, ultimately, it’s a matter of that person’s freedom.  Freedom of association must logically extend to freedom to have whatever relationships you like.  I absolutely believe that there should, in some circumstances, be the option for the wronged party to sue for emotional damages if circumstances are that severe, but unless I’m greatly mistaken, that is already allowed.

The fact that an action is immoral does not represent evidence that it should be illegal.  In fact, morality and legality MUST be kept separate, for the sake of the stability of the nation and the society.

If fidelity was part of your wedding vows, then you can totally hook an adulterer on breach of contract.

But making the act itself illegal opens a lot of doors that should not be opened. You give the government permission to prosecute you and your partners for having a threesome. You make polyamorous relationships forbidden by law. You set a precedent for governmental control over any part of your sex life that deviates from the official legally mandated norm.

Don’t get me wrong, cheating on somebody you claim to love is an absolutely vile act. But there’s no law that prevents it without hurting a whole lot of bystanders.
